L0lis – Italy punishes intentional access to +18 content

The Italian parliament has introduced a new crime in article 600-4º paragraph 3 of the penal code, which punishes "(intentional) access to +18 material". Previously, access to +18 child material went unpunished, since the crime of possession (detenzione) involved at least downloading.

Therefore, the new legislative intervention covers the loophole for those who access websites with this content without downloading it. However, this implies a clear anticipation of the use of criminal law in cases of possession; the individual is punished simply for intentionally viewing it.

The Italian Court of Cassation also applies the concept to hentai comics and anime , the so-called "fully virtual pornography".

The Italian court said that possession of this material is a crime of concrete danger and, in the case of comic books, the danger is represented by the evocation of real situations in which "children are reduced to mere sexual objects."

What does L0lis mean?

Loli means "Little Girl," referring to girls or anime characters with childlike and cute features, generally aged around 8 to 14 years old, who then acquire cute, childlike, and innocent characteristics.
